ANZ Tickets Affiliate Program Terms and Conditions

1. Introduction

These Terms and Conditions ("Terms") constitute a legally binding agreement between you ("Affiliate", "you", "your") and ANZ Tickets ("the Company", "we", "our", "us") regarding your participation in the ANZ Tickets Affiliate Program ("the Program"). By enrolling in the Program, you agree to comply with these Terms, which govern the promotion of tickets and the accrual of referral commissions.

2. Eligibility and Enrollment

• - Age Requirement: Affiliates must be at least 18 years of age.
• - Professional Standing: Participation is open to influencers, content creators, and businesses with a verifiable online presence relevant to the entertainment and ticketing industry.
• - Approval: Enrollment is subject to a formal application process. ANZ Tickets reserves the absolute right to approve or reject any application at its sole discretion.

3. Commission and Payment Terms

• - Commission Accrual: Commissions are earned on completed and verified ticket sales generated via your unique referral links.
• - Payment Schedule: Payments are issued within 15 business days following the conclusion of the event to your nominated Australian bank account.
• - GST Treatment: All commission rates are inclusive of GST. Affiliates are responsible for their own tax obligations and must provide a valid ABN if applicable.
• - Adjustments: ANZ Tickets reserves the right to deduct or withhold commissions in cases of customer refunds, credit card chargebacks, or suspected fraudulent activity.

4. South Australian Regulatory Compliance

• - Resale Price Caps: In accordance with the Fair Trading Act 1987 (SA), Affiliates are strictly prohibited from advertising or promoting tickets at a price exceeding 110% of the original supply cost.
• - Prohibited Software: The use of "ticket bots" or any automated software to facilitate ticket purchases is strictly forbidden.
• - Disclosures: Under Australian Consumer Law, Affiliates must clearly and prominently disclose their commercial relationship with ANZ Tickets (e.g., using "#ad" or "Affiliate Link") to avoid misleading or deceptive conduct.

5. Affiliate Responsibilities

• - Ethical Promotion: You must promote ANZ Tickets honestly and accurately. Misleading claims regarding event features, availability, or pricing are prohibited.
• - Marketing Restrictions: You may not engage in "spamming" or unauthorized email marketing in violation of the Spam Act 2003 (Cth).
• - Search Engine Marketing: Bidding on ANZ Tickets trademarks or brand-related keywords in paid search (e.g., Google Ads) is prohibited without prior written consent.

6. Intellectual Property

• - Limited License: ANZ Tickets grants you a non-exclusive, revocable license to use approved brand assets and logos solely for the duration of your participation in the Program.
• - Restrictions: You may not alter, distort, or misrepresent ANZ Tickets branding. All intellectual property remains the exclusive property of the Company.

7. Tracking and Attribution

• - Cookie Duration: Referral tracking is powered by cookies with a 90-day validity.
• - Attribution: The Program utilizes a first-click attribution model unless otherwise specified in the Affiliate Dashboard.

8. Data Privacy

• - Compliance: Both parties agree to handle all personal data in accordance with the Privacy Act 1988 (Cth) and the Australian Privacy Principles (APPs).
• - Confidentiality: You must protect any proprietary information or customer data accessed through the Program and refrain from sharing it with third parties.

9. Termination

• - Right to Terminate: Either party may terminate this agreement at any time with written notice.
• - For Cause: ANZ Tickets may terminate your account immediately for breaches of these Terms, fraudulent behavior, or actions that harm the brand's reputation.
• - Post-Termination: Upon termination, you must cease all use of brand assets and referral links. Any valid, outstanding commissions will be settled following the conclusion of the respective events.

10. Limitation of Liability and Indemnity

• - Liability: To the maximum extent permitted by law, ANZ Tickets is not liable for indirect or consequential losses arising from your participation in the Program.
• - Indemnity: You agree to indemnify and hold ANZ Tickets harmless from any third-party claims, damages, or legal costs resulting from your breach of these Terms or violation of South Australian law.

11. Governing Law and Jurisdiction

• - Governing Law: These Terms are governed by and construed in accordance with the laws of South Australia.
• - Jurisdiction: Both parties irrevocably submit to the exclusive jurisdiction of the courts of South Australia and the Adelaide registry of the Federal Court of Australia for the resolution of any disputes.
